By accessing or using the website at lelyresortconcreteandmasonry.com (the "Site") or by engaging Lely Resort Concrete & Masonry ("we," "our," or "us") for masonry services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or engage our services.
Lely Resort Concrete & Masonry provides residential and commercial masonry services in Lely Resort, FL and surrounding communities. Services include but are not limited to foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, and related masonry work.
All services are subject to a written estimate and a signed agreement before work begins. We reserve the right to decline any service request at our discretion.
Estimates provided by Lely Resort Concrete & Masonry are based on information available at the time of the site visit or inquiry. An estimate is not a guaranteed final price. The actual cost of work may change if the scope of the project changes, if unforeseen conditions are discovered during the work, or if material or labor costs change between the estimate date and the start of work.
We will notify you of any material changes to the estimated cost before proceeding with additional work. Price changes beyond the original scope require written authorization from you before they are incorporated into the job.
Scheduled appointments are subject to availability. We will make reasonable efforts to honor scheduled times. Delays caused by weather, material availability, or other circumstances outside our control may require rescheduling, and we will notify you as promptly as possible.
If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible by phone or email. Late cancellations - generally defined as notice provided fewer than 24 hours before the scheduled start - may result in a cancellation fee if crew or materials have already been committed for your job. Any applicable cancellation fee will be stated in your service agreement.
We reserve the right to cancel or reschedule a service appointment if site conditions are deemed unsafe or unsuitable for the work to proceed. In that case, no cancellation fee will apply.
Payment terms are set out in your written service agreement. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, a deposit may be required before work begins, with the balance due upon completion or at agreed milestones.
Accepted payment methods will be specified in your service agreement. Invoices that are not paid within the timeframe stated in the agreement may be subject to a late fee, as specified in that agreement.
If payment is not received and we are required to pursue collection, you agree to pay reasonable costs of collection, including reasonable attorney fees, to the extent permitted by applicable law.
Any warranty on completed masonry work will be stated explicitly in your service agreement. Where a warranty is provided, it covers defects in workmanship under normal use and conditions. Warranty coverage does not extend to damage caused by events outside our control, including but not limited to hurricanes, flooding, extreme weather events, soil movement beyond the scope of the repair, acts of third parties, or failure to follow maintenance instructions provided at project completion.
The Site and all information on it is provided "as is" without warranty of any kind. We make no representations or warranties regarding the accuracy or completeness of the information on the Site.
To the fullest extent permitted by applicable law, Lely Resort Concrete & Masonry and its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of our Site, reliance on information on our Site, or the performance of masonry services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a specific service engagement shall not exceed the total amount you paid us for that engagement.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
All content on the Site, including text, images, logos, and design elements, is the property of Lely Resort Concrete & Masonry or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.
We want to resolve any concerns you have promptly and fairly. If you have a dispute related to our services or this agreement, please contact us first at contact@lelyresortconcreteandmasonry.com or (239) 445-0743. We will make a good-faith effort to resolve the matter informally.
If informal resolution is not possible, any dispute arising out of or related to these Terms or our services shall be resolved through binding arbitration in Florida, in accordance with the rules of a mutually agreed arbitration provider, unless both parties agree in writing to an alternative process. The prevailing party in any dispute may be entitled to recover reasonable attorney fees and costs to the extent allowed by Florida law.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Florida.
We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will post the revised version on this page with an updated effective date. Your continued use of the Site or engagement of our services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
